A Morgan Township woman accused of driving under the influence with two children in her car last month in Waynesburg waived some charges to court during her preliminary hearing Wednesday afternoon, while the most serious charges were withdrawn.
Juanita Marie Martin, 40, of 196 Kennel Road, was traveling west on East High Street at 11:50 p.m. June 7 when she was stopped by borough police for not having a license plate light, court documents indicate.
Police said they smelled alcohol, and Martin indicated she could not perform field-sobriety tests due to pre-existing conditions.
She was arrested, and a breath test indicated a blood-alcohol content of 0.117, police said, just above the legal limit to drive in Pennsylvania.
Two children were in the vehicle at the time of the stop.
Felony charges of endangering children were withdrawn at Wednesday’s preliminary hearing before District Judge David Balint, but misdemeanor driving under the influence and reckless endangerment charges were waived to trial, along with a summary driving violation, according to online court records.
